Timescales for your sale or purchase will depend on whether there is a chain involved and your mortgage offer. Time taken to answer enquiries by the sellers solicitors. Our aim is to deal with all correspondence as quickly as possible.
A partner will act for you in relation to the Probate. An initial interview will be carried out to find out what assets the deceased had. We will then write to all the asset holders to find out the value of the asset on the day the deceased passed away. If there is no Will then we will again ascertain the assets of the estate and advise accordingly on the best way forward.
Once the value of the Estate is known we will prepare the necessary Inland Revenue forms depending on the value of the Estate and as to whether Inheritance Tax is payable and prepare the legal statement which will be signed by the Executors and submitted to the Probate Registry with the appropriate fee. If there is no Will then we will prepare the necessary documentation in order to obtain the Letters of Administration.
If we are acting in the administration of the Estate then we will prepare the Estate Accounts pay any debts or liabilities to the Estate and distribute the assets in accordance with the Will.
Once the property is sold and other assets obtained we will prepare the Estate Accounts and administer the Estate according to the Will or under the Intestacy rules if there is no Will.
The time taken to administer the Estate will depend on a number of facts such as the time it takes to sell the property and obtain other assets. Other factors may be the number of beneficiaries. For example if there is a foreign property or foreign assets. The time taken by the Probate Registry to respond in obtaining the Grant of Probate or Letters of Administration.
